長期照顧服務法之建制－－兼論私法關係之存在與操作

The Structure of Long-Term Care Services Law-Extend Study on Private Law Relations

我國由於人口結構及社會環境的變遷，逐漸導致失能人口急速增加，進而在長期照顧服務上有一定程度之需求，現階段已成為社會所應面臨及解決之課題。因此為能健全長期照顧服務體系，政府已修正通過長期照顧服務法，透過整合相關機構及對長照人員之規範，得以確保長照服務品質，同時保障長照服務使用者之權益。本文首先探討長期照顧服務法之建制，包含制度規劃及規範對象等，據以審視法條之整體規範，另外針對長照服務當事人間之私法關係進行分析，包含長照機構、接受長照服務者、照顧服務員之角色定位、代理關係、監護制度，以及定型化契約簽訂、僱傭關係之責任分辯等，以因應後續在長照服務法施行後，在未來運作上所可能產生之私法課題，藉以健全未來長照服務與保障接受服務者之尊嚴與權益。

As population structure and social environment change in Taiwan, leading to the rapid increase in disabled population gradually, and then in the longterm care services have a certain degree of demand, which should face and solve the problem at this stage. Therefore, in order to improve the long-term care service system, the Government has amended the long-term care services law to ensure that the quality of service is guaranteed by integrating the relevant organizations and the long-term staff. This paper discusses the establishment of long-term care service law at first, including the system planning and normative objects to the overall norms of the law. Besides, we also analyze the private relations between the parties relationship, including long term care service institution, role of care worker, the use of agents or guardianship relationship, the regulation of the contract and the signing of the employment relationship between the responsibility of the resolution, in order to comply with the long-term care service law in the future operation of the possible operation of private law issues, and improve the future longterm care service and protect the service and caregivers of the dignity and interests.
