論陸海空軍刑法關於「戰時」規範效應

Discussion on Effects about 'Wartime' Norms in Criminal Code of the Armed Forces

關於「戰時」這個用語，在陸海空軍刑法之中，依其規範內容及性質觀察，可約略區分為：一、平、戰時之區隔；二、作為阻卻違法之情狀要素；三、擴張適用之範圍時機；四、作為構成要件之情狀要素。而在審判系統上，戰時亦為啟動軍事審判機制的轉換時點。本文即針對於上述幾點特徵，純就法理上探討。

The term 'wartime' in Criminal Code of the Armed Forces, according to its normative content and nature, can be roughly divided into 4 aspects: first, the division of war and normal time; second, an element of the legitimate ground; third, the moment to expand the scope of being applied by Criminal Code of the Armed Forces; fourth, an element of a crime (or an offense). Wartime is also the conversion point of being activate military trial. This article is to discuss the above characteristics on the legal theory.
