論智慧財產權法律對技術創新的功能

本文從技術創新在經濟增長中的重要地位及當代技術創新的特點出發，運用產權理論、交易費用理論等理論工具和實證資料，從制度保障、行為激勵、資源配置和系統整合等四個方面對智慧財產權法律制度對技術創新的功能進行分析論證，意在揭示智慧財產權制度與技術創新之間內在的經濟聯繫，以此促進對技術創新法律制度建設的重視。

Beginning with role of technical renovation in the growth of economy and the features of renovation, this thesis analyzed the function of property law effecting renovation, through the tools and positive materials such as theory of property right, expenses of bargain. Focusing on the aspects such as support of system, encouragement of behavior, disposal of resources and integration of system, it was aimed at disclosing the economic connection between intellectual property law and renovation, to boost the buildup of the system of law and regulations on renovation.
