法律本乎人性，情、理、法三者孰重孰輕，一直是個熱門不休的話題。刑法親親相隱在傳統中國千餘年法史長河中始終存在，有其深厚儒家思想理論根基，本文將梳理其制度歷史之演變。1902年清末變法修律後，全面改採西方法制，然直迄民國當代親親相隱幾無甚麼更動；直到民國38 年中華人民共和國取得政權後，因其本著社會主義立法原則，刑法中親親相隱思想被廢除，但近來不斷有恢復之聲。本文將試析親親相隱歷史由來及其法理基礎，晚清繼受外國法制後，何以親親相隱條款絲毫不受影響；尤有進者，本文將比較各國親屬容隱立法例，藉由當代刑法理論之探討以明親親相隱之社會意義與法律價值，並提出容隱權符合憲法基本精神應在憲法理念下維護等個人建議。

The legal immunity ofr elatives keep remaining over thousands ofyear s until late Qing in Chinese legal history. The Confucianism provide the basic theory oflegal immunity. This article will trace the history and evolvement oflegal immunity. In the late Qing legislative reforms, the law has tremendous changes. However, the legal immunity has few changes. Until 1949 the People's Republic of China take power, based on Socialism Legislative Principles, the legal immunity in criminal law was abolished. However, many people want to recover it.
This article will trace the history and jurisprudence ofl egal immunity in the Chinese History. Comparing with other countries legislation, and discover the value and social meanings oflegal immunity by criminal law theories. The Author also consider legal immunity meets the basic spirit of Constitution and thus should be well protected by the Constitution.
