開放政府資料下應加強醫療隱私法律規範

Open Government data should strengthen medical privacy laws

由於資訊科技產業的蓬勃發展，各先進國家紛紛推動跨國資訊整合計畫與相關政策。就我國而言，醫療與健康資料的主要來源是台灣全民健保資料庫，該資料庫保存所有國人的醫療與健康資料，然而，制度上卻缺乏完備的法律規範來監督或執行該資料庫的資料存取與使用。為了保護個人對醫療資訊的自主決定權，免於揭露醫療資訊造成人格貶損與負面評價，並給予病患個人得以獲取完整精確的醫療照護，醫療資訊隱私權應當給予保護，賦予個人得以控制自己醫療資訊的權利，因此須受到更嚴密的保護規範。美國HIPAA 隱私規定，主要在規範病歷以及其他可資辨識個人身分之健康醫療資料的使用與揭露，規範效力所及的健康資訊形式泛及電子處理之資訊。隨著醫療與資訊技術的進步，會對未來的醫療資訊隱私權產生很大的影響。從醫療產業的發展來看，醫療資訊電子化可以減少浪費，同時增加醫療品質與效率，也由於醫療資訊電子化所帶來的效益，讓各國政府都投注大量資源來建置相關系統。在個人資訊隱私與醫療產業發展下，建立一個完善的醫療資訊使用環境，就成為當務之急。

Because of the booming information technology industry, developed countries have to promote the transnational information integration plans and related policies. In Taiwian, the medical and health information is the main source of Taiwan national health insurance research database, the database save all people of the medical and health information , however, the system is a lack of comprehensive laws and regulations to supervise or perform data access and use of the database. In order to protect the personal medical information of self-determination right, from revealing personality derogatory and negative assessment of medical information, patient care of individuals to obtain complete and accurate health information privacy should be protected, and give the right of individuals to control their own medical information, , and therefore should be subject to more stringent protection norms. United States HIPAA privacy regulations, mainly in the norms of medical record and other available resources to identify the personal identity of health care information use and disclosure, normative force and form of health information pan and the electronic processing of information. As medical and information technology advances, the future of medical information privacy have a huge impact. while increasing quality and efficiency, and also due to the benefits of medical information. From the development of the medical industry, electronic medical information can reduce waste while increasing quality and efficiency, and also due to the benefits of medical information. Under the personal information privacy and health industry development, the establishment of a comprehensive medical information environment, has become a top priority.
