律師與當事人決策權的分配－－以英美法為中心的分析

Allocation of Decision- making Authority between Lawyer and Client Analysis Centered on Anglo- American law

律師與當事人之間決策權的分配分為兩種模式：律師控制模式和當事人控制模 式。英美實行的當事人控制模式理論認為，律師與當事人之間主要是一種私法上的契約關係，在訴訟目標上，律師應當尊重當事人的意志，在訴訟策略上，律師也應當在充分告知服務方案及其法律後果的基礎上協助當事人進行選擇。如果無法達成一致意見，律師只能選擇聽從被告人的意見或者退出委託代理關係。我國的律師控制模式過於僵化和絕對，由於訴訟環境的改變，應當建立起最低限度的當事人控制模式。

The allocation of decision-making authority between lawyers and clients is divide into two ways: lawyers-control model and client-control model. Client-control model regards the relationship between lawyers and clients as a private contractual relationship, which means lawyers should obey the client's will on the goal of action, lawyers should help clients to choose on the basis of informing legal service proposals and consequences. If they can't reach an agreement, lawyers can only obey the clients or resign. Lawyers-control model in China is unduly absolutely, the minimal client-control model should be established due to the change of circumstances.
