論隱私權－－以使用RFID於追蹤病人及員工之醫院為例

The Right to Privacy Research--A Study Case of Using RFID Tracking to Patients and Employees in Hospital

由於RFID 在物流業作為貨物追蹤之成效相當卓越，因此國內現在有幾家 區域醫院以上之醫療機構以示範性的計畫，推廣RFID用來進行病人及護理人 員的追蹤，以利當醫療院所內爆發法定傳染病時，能迅速地知道與這名患有 法定傳染病的病人接觸的人員有哪些，並儘怯地進行隔離，以免造成疫情的 蔓延。由於整個率統運作幾乎是運用電腦處理，因此醫療院所應該依據電腦 處理個人資料保護法之規定，除了有特定之目的外，並須經受追蹤之當事人 同意下，始能除罪化。所以醫療院所應向所有進行追蹤之人員詳細說明其目 的、醫院內部控管的程序如何並經當事人同意後，始得進行之，以避免侵犯 個人之隱私權。

Because of the excellent performance of RFID (Radio Frequency Identification) tracking system in the industry of cargo transportation, a few region hospitals adopted this system to be their new tools on the tracking of their patients and nursing staffs. When an infectious disease spreads in the hospitals, the hospitals could be rapidly informed by RFID. In addition, the hospitals can get lists of infected people who contacted patients before. Therefore, they can isolate these people to prevent a further infection. Computers completed all of RFID operation. For this reason, hospitals should follow the policy of using the personal data on the computer in order to protect the right of patient s privacy, except for specified purpose. Before the collection of patients data, the hospitals should get agreement from patients who will be monitored to avoid offense. Consequently, the hospitals have to explain their purposes of collection and procedure of internal control of the hospitals to their patients.
