Medical Care Dispute in Taiwan--A Review

醫療糾紛走困擾醫師及醫院的社會事件。醫療糾紛肇因於醫療疏失，使 病人健康權益受損，但實際並無疏失或因其它因素而生之糾紛更多，醫療糾 紛之面相至為複雜，多樣。本文針對醫療不良事件之類別，台灣醫療糾紛之 特質，發生原因及醫病雙方如何維護自身權益有所論述。對於醫界熱衷之 “去刑化'問題及醫糾訴訟是否有“醫醫相護'也表示了作者之閱歷及意見。 本文認為“訟則終凶'，醫師要用心看病，病人要勇敢發悶，政府要努力制訂 相關法律，使醫療更上軌道，不理性的糾紛減少。

Medical care dispute is a multiphasic phenomenon. Physicians and hospitals often encounter the dispute with little knowledge about the characteristics of the confrontation. Patients do not know the limitation of medicine and judicial procedure too. All of these generates more dispute. The author narrates the multi-factors that cause malpractice and dispute or law suit in Taiwan. It is hoped that readers can learn from this article and avoid being involved in a dispute.
