國際私法上侵權行為準據法立法新趨勢與東亞諸國侵權行為準據法之改革

New Legislative Developments on Choice of Law in Torts on Private International Law and the Reform of East Asian Private International Law

韓國「國際私法」於2001年並施行，日本「關於法律適用之通則法」於2006年通過並於次年施行，中華人民共和國「涉外民事關係法律適用法」於2010年通過並於次年施行，我國「涉外民事法律適用法」於2010年通過並於次年施行，韓國、日本與海峽兩岸新國際私法之問世，應能帶動東亞國家國際私法之現代化，對亞洲國際私法之發展將有深遠影響。面對東亞涉外民商事法律關係法律適用法制之嶄新面貌，本文聚焦於侵權行為準據法，從歐洲國家國際私法之修訂或新訂浪潮所形成侵權行為準據法發展新趨勢，檢視韓國、日本與海峽兩岸新國際私法中涉外侵權行為法律適用之規定，期能從制度論角度，對海峽兩岸新國際私法侵權行為準據法之規定，提出分析、評論，並比較其間之異同優劣。

Korea has legislated new private international law legislations in 2001. Japan has legislated new private international law legislations in 2006. The two sides of the Taiwan Straits have both legislated new private international law legislations in 2010. The four new private international law legislations influence developments of Asia private international law deeply. Facing the new situation, it is necessary to analyze the four new private international law legislations further. By concluding the new developments of choice of law in torts of the time, this article tries to compare and comment these articles related contracts in the four new private international law legislations from the views of the new developments of choice of law in torts.
