我國專利保護的強度及改進措施－－以2013年數據中私營企業專利權人為視角

Analysis of China’s Patent Protection Strength and Improvement Actions on the Social Satisfaction of Patent Protection：Based on the Perspective of the Private Company Patentees in 2013 SIPO Social Satisfaction Survey of Patent Protection

隨著我國經濟轉型升級的日益加快，知識產權在經濟發展中的貢獻日益突出。全面深化改革的持續推進也進一步釋放了私營企業的發展活力。據統計，占我國私營企業絕大多數的小微企業完成了65%的發明專利，已成為我國科技創新的主力軍。在國家知識產權局開展的專利保護社會滿意度調查工作基礎上，基於私營企業專利權人的視角對當前我國專利保護的強度進行考察。數據分析顯示，目前私營企業專利權人對我國專利保護的滿意度有66.73分，僅僅剛達到及格水平；而私營企業專利權人在反饋意見建議時，同樣表示希望相關部門加大專利保護力度。在加強專利保護的過程中，司法要充分發揮對專利保護的主導性，行政要充分發揮在專利保護中的主體性，非訴調解要充分發揮在處理專利糾紛時的主動性，私營企業專利權人則應充分發揮自身積極性，配合做好相關工作。

With the accelerating pace of China’s economic transition and upgrading, the contribution of intellectual property in economic development is increasingly prominent. Also with the deepening of the reform and development of market economy, private companies’ activity in economic development has also been released. According to statistics, small and micro enterprises had 65% of patents, having been the main force of technological innovation. Based on the social satisfaction survey of patent protection by the State Intellectual Property Office of the P.R.C, this paper is to study the current patent protection strength on the perspective of private company patentee. The data shows that the current private company patentee’s satisfaction of patent protection is 66.73, just having reached the passing level. The private company patentees’ feedback also shows they have high expectations of our patent protection strength. And in the process of strengthening patent protection, the point is to strengthen the patent enforcement. Specifically, the judiciary should play the dominant role in leading patent protection, administration should play the subjective role in the patent protection, non-litigation mediation should play the initiative role in dealing patent disputes, the private company patentee should give themselves full initiative to the related work.
