Joint-Ownership of Performer’s Rights

兩個以上的民事權利主體就同一表演活動共同享有的表演者權稱為共有表演者權。共有表演者權既可以通過共同的表演活動原始產生，也可以通過轉讓和繼承的方式繼受取得。共有表演者權的權利主體包括自然人和法人組織，權利對象為靜態的表演形象和動態的表演活動，權利內容則具有人身權和財產權的二元屬性。共有表演者權的權利歸屬以及許可、轉讓等行使規則比較复雜，但我國現行《著作權法》幾乎沒有規定，應完善相關立法，以約定優先、鼓勵傳播的原則確立其行使規則。

There are two origins of joint-ownership of performer’s rights: the common performance production and successors by transferring or inheriting. The joint-ownership is a very common phenomenon in joint performances, but there is few regulation about it in our copyright law. Based on other country’s legislations, this essay investigates the definition, right structure and the exercise rules of jointownership of performer’s rights.
