論民事再審檢察建議的制度價值與完善路徑

The Value and Improvement of Prosecution Recommendations of Civil Retrial

民事再審檢察建議是檢察機關在實踐中發展起來的一項重要的民事檢察工作方式，具有實施柔性監督、優化資源配置、調和法檢關係和加強權益救濟等重要價值。不過，民事再審檢察建議在實際適用中仍然面臨法律規定框架粗糙、採納率有待提高、行文不規範以及跟蹤監督不及時等諸多問題。對此，應該在秉持維護當事人私人權利、尊重法院獨立審判、提高司法裁判效率和重塑協同監督理念的基礎上，從明確適用範圍、完善製作程式、建立考評機制、提高說理水準、嘗試監督公開以及完善複查程式等幾個方面來進行制度完善和優化。

Prosecution recommendations of civil retrial is a well developed way of procuratorial supervision in China , which values implementing flexible supervision, optimizing the allocation of resources, mediating the relationship between courts and procuratorial authority and improving the protection of civil rights. However, the implementation of prosecution recommendations of civil retrial has been encountered many obstacles which include the rough law concerning it, the low adaption rate, not standardized wording and so on. To deal with it, we should retain the principles of protecting the civil rights, respecting judicial independence, improving judicial efficiency and rebuilding the cooperative supervision , and improving the system from six aspects.
