瑞士債法總則改革學者建議草案（OR 2020）譯介

The Draft of Academic Proposal to the Reform of General Part of Swiss Law of Obligations (OR 2020): An Introduction and Translation

2007年始，瑞士全部9所法律院系中的23名私法學者開始聯合著手編寫債法總則改革建議草案（簡稱OR2020），從而革新現行債法的第一分編。在剛慶祝完瑞士現行債法實施100周年之後的2013年，這一學者建議草案正式出版發行，並獲得了政治上的一些支持。有聯邦議員提出動議，以這部學者建議草案為基礎，開展現行債法總則的變革，並獲議會採納從而正式啟動立法修改程式。雖然目前這一學者建議草案最後變為立法現實的前景還不明朗，但對這一草案推出的背景和目標、起草過程和方法、體例更新和內容變化等方面進行考察，對於我國未來民法典的起草、債法總則的制定和具體制度的完善都有其學術價值和現實意義。

From 2007, 23 private law scholars from all Swiss law faculties began an academic project to draft a proposal for a modernized General Part of Swiss Law of Obligations. At spring 2013, the outcome of this academic research has been published, that is, Schweizer Obligationenrecht 2020： Entwurf für einen neuen allgemeinen Teil, abbreviated by German as OR 2020. The academic effort has already found some political supports and two federal congressmen have officially submitted two Postulates, which suggest the beginning of reforming work based on OR 2020, and the Swiss Federal Parliament has also accepted the proposal, so the legislative process has been opened. Although the prospect of this proposal draft now is not clear, the investigations into this project still have the academic value and realistic signification for our country.
