論我國不動產登記制度中的主要缺陷－－寫在物權法通過以後

On the Major Defects of Regestration of Real Estate in China

不動產登記是物權對世效力和公示原則的基本要求，但我國尚無不動產登記法。目前我國不動產登記制度中的明顯不足就是理論基礎模糊不清，制度設計簡單粗糙，缺乏可操作性。現行有關不動產登記的法律不僅零散，而且存在不少錯誤，有的甚至違反物權法的基本原則，這種制度缺陷直接危及當事人的切身利益與市場交易的秩序與安全。本文分析了我國不動產登記制度中存在的主要缺陷，以期有利於完善我國的不動產登記制度。

The registration is the basic requriement for real estate because of the absolute effectiveness and publication principle of right in rem, but up till now China have not adopted the law of registration of real estate. At present, the major defects in regaistration are as follows: the basic theory is not clear, the legal arrangement is simple and scattered, some arrangement is not easy to execute, and somea arrangement even violates the basic principles of right in rem. These defects are harmful to the interests of the party conerned, and this is unfavorable to establish an order and safe market for transfering of propery. The paper analyses the major defects in registration of real estate so as to improve it in China.
