意思表示錯誤研究及其對我國民法立法的啟示

Research on the error of the will declaration -- From the Roman law to the modern law

作者自羅馬法展開對意思表示錯誤的歷史考察，從比較法的角度結合當前先進國家的立法進行透視，進而對我國意思表示的現行立法規定和理論研究現狀進行剖析。作者認為我國立法在設計意思表示錯誤時，應該從歷史的和比較法的視野吸收此制度的相關先進規定。然後作者對意思表示錯誤的概念範圍作出界定，認為我國的意思表示錯誤的立法設計應該包括：動機錯誤、內容錯誤、書寫錯誤、計算錯誤、標的性質錯誤、傳達錯誤以及受領人錯誤。最後作者還明確提出意思表示錯誤在我國民法典中的具體條文設計。

Now China is on the way of drafting the civil code. But how to write the concrete articles of the error of the will declaration in this code deserves researching. In order to settle down this problem, the author has done the research of this project from the historical and comparative aspects. By doing this work, the author gives the commendations of the current legal theory and legislation. The author minds that China should accept the good regulation from the point of the historical and comparative law. Then he gives the scope of the concept of error of will declaration, and argues that the system of error of will declaration in Chinese Civil Code should include the following aspects: the motive error, the error of the content, the error of writing, the error of calculating, the error of the object, the error of the sending and the error of the receiver. At last the author suggests the concrete articles of the error of the will declaration in Chinese Civil Code.
