理想的衝突規則設計與現實的法院地法約束－－評《關於合同義務法律適用的羅馬公約（1980)》

衝突規則以及統一的衝突規則被認為是解決不同法域間法律衝突的一個捷徑，但是在現實世界中，這條通向法律一統的道路充滿阻礙，使得這一主張更像是一個在現有法律命題中發展起來的理想化的法學理論衍生物。在現實條件的制約下，衝突法不得不不斷擴張其彈性以求生存，但這個彈性越大，這個制度距離其所服務的目標也就越遠。

The rules of conflict of laws a nd the unification of the conflict of laws are considered a shortcut towards the solution of the conflict of laws among different jurisdictions. In the real world, though, this preposition is simply too idealistic to be realized due to the restraints of the selective favoritism towards lex fori. Under this circumstance, conflict of laws has to extend its flexibility. However, the more flexible the conflict of laws is, the further it is from the aims it is supposed to serve.
