一般人格權的確立及其適用

文章在說明一般人格權的自然權利屬性的基礎上，主要致力於從社會實證、法理論構成及法規範體系等層面為一般人格權制度於實證法上的確立提供論證支持，並嘗試為一般人格權制度的具體法律適用尋獲有效的法律方法。

On the basis of the explanation of the natural right attribute of general Personality right, the author devotes himself to demonstrating the establishment of general personality right on positive law from such aspects as social practice, the constitution of legal theory and the system of legal norm.
