大陸法國家民法典研究

本文共分五節。第一節開門見山地指出了研究大陸法國家的幾部主要民法典對於制定我國民法典的必要性。第二節在介評法國民法典的基礎上，著重分析了其革命精神和思想史上的價值。第三節在介評德國民法典的基礎上，重點剖析了其立法技術。第四節在介評瑞士民法典的基礎上，主要闡釋了其民商合一的特點與原因。第五節在介評日本民法典的基礎上，特別分析了日本在移植外國法律過程中的經驗與教訓。在這種介評的基礎上，文章態度鮮明地指出了我國制定民法典應該從中吸取的經驗與教訓。

This thesis beholds that making full exploration of the typical civil codes of the civil law System is necessary to our legislation on civil code. After carefully introducing and analyzing the codes, the article then goes to highly view the France Civil Code’s revolutionary spirit and its valuable Status in the history of legal thoughts, analyze the legislative technique in the German Civil Code, bring forth the feature of the Swiss Civil Code--combination of civil and commercial codes--and its reason. As to the Japan Civil Code, the paper casts more light on the legislative experience and lessons of the Japanese in transplanting foreign laws. Above all, the author put forward what we should learn on the way of drafting our Civil Code.
