In order to safeguard the right to a fair trial of the people, the Judges Act passed in 2011 allows the establishment of two committees—the Judge Evaluation and Prosecutor Evaluation committees—under the Judicial Yuan, which would handle complaints against judicial personnel. Passage of the Judges Act had been pending for 23 years. The current law, however, is a product of highly politicized considerations and compromise. As such, the Act is far from ideal. In mid-April2012, the Judicial Reform Foundation reported that Kuan-Yu Lin (林○佑), a prosecutor at the Taipei District Prosecutors’ Office, had a vicious manner in court, telling a female victim of a car accident that women should not drive cars and should stay home taking care of their children. In this study, I would like to introduce and analyze this famous “Angry Bird Prosecutor” Case from the legal viewpoint. |
