Comprehensively Promoting the Protection of Human Rights under the Horizon of Rule of Law

人權保障不等於人權，它來源於人權理論。它們的重心已悄然地發生著變化，即由以人作為人權的主體轉換成了以國家作為人權保障的主要實施主體。視域是一種與主體有關的能力，是“精神的觀”。而我國的人權發展進程也歷史地注定了我國人權保障視域的獨特性。當下，它的時代含義是：國家以保障人權為目標，更好地發揮法治的引領和規範作用。

Guarantee of human rights doesn’t mean human rights itself. It originates from the theory of human rights, but its subject is quietly changed. That is, people as the subject of human rights transformed into country as the main subject of implementation of safeguarding the human rights. Horizon is a kind of ability related to the subject and a kind of observing by spirit. Meanwhile the historical development of human rights in China determines the uniqueness of our horizon on safeguarding the human rights, and its contemporary sense, by, is that the state shall aim at pursuing the guarantee of human rights and better play its role of the rule of law in guiding and normalizing.
