The provision regarding proposer's disclosure duty in Simple Life Insurance Act is similar to Insurance Act Article 64, but actually different. For contestable period aspect, Simple Life Insurance Act provides that "If the insured event occurs two years after the conclusion of the contract, the insurer may not cancel the insurance contract." Supposed the insured event has been occurred within contestable period (two years), and insurer cancelled on the date which has been expired. It would be attributed to different decisions, depending on whether to be applicable to Simple Life Insurance Act or Insurance Act. Recently, the first and second instances in Taiwan Kaohsiung District Court & Taiwan High Court Kaohsiung Branch are sentencing disparity on the above-mentioned issue. This Article concluded that Simple Life Insurance Act is prior applicable to Insurance Act, insurer would cancel the insurance contract, even if contestable period has been expired. |
