由保險經紀人法律之定位談保險經紀人管理規則第28條之修正

A Review on the Legal Position of an Insurance Broker and the Amendment to Article 28 of the Regulations Governing Insurance Brokers

為達到保險制度能有效且公平合理的運作，尤其著眼於確保投保之一方能實質具備有與保險人議定及處理保險契約及其再保險契約之能力，於制度的設計上實有必要規劃一種專業人員能專責為投保之一方服務，以使得保險契約雙方能基於平等相對之立場互為磋商及議定處理保險契約及其再保險契約。「保險經紀人／再保險經紀人」即係立於這個制度上的目的而於保險實務及法律演進所規劃出來之角色。「保險經紀人／再保險經紀人」於法律地位上係屬保險輔助人之一種，於保險監理上，同由保險監理之主管機關進行必要之監督及管理措施。保險市場之監督管理，就如同運動場上的競技，保險監理主管機關就如同運動場上的裁判，其職責需確保比賽進行的公平與順利，保險市場之監督管理者（Regulator），需以公平對等的角度看待保險契約關係中各方主體間所進行之市場活動，以謀保險市場運作之順暢與公平合理。

It is important to have the professional assistant role to assist insurance applicant in dealing of insurance/reinsurance contract with insurers/reinsurers, on the purpose to secure the insurance applicant's position is substantially capable of the insurance/reinsurance negotiation and handling, on the way to ascertain insurance system is functioning fairly and effectively. Insurance/reinsurance broker is such an important role as developed by the long run history of insurance practice and legal tide of thought. In legal aspect insurance/reinsurance broker is an insurance intermediary; it is under the supervision of insurance regulatory body. The supervisory of insurance market, just as in the other field of skill competition, eg. Sports game, the regulator is the judge in a game to keep the competition being progressed smoothly and justly. The insurance regulator has to make sure the insurance market is well performed under fairness rules, adequate and equal treatment to activities conducted by each party in an insurance contract.
