論外籍配偶的法律地位－－以入境、居留與歸化為中心

The Legal Status of Foreign Spouse - from the Aspects of Entry, Permanent Stay, and Naturalization.

一國如何規範外國人的法律地位，足以代表該國文明開化程度。其中，對於本國國民配偶的外國人（外籍配偶），屬於較為特殊的狀況。伴隨國際間人口流動頻繁以及兩岸的交流開放，使國人與外籍或大陸人民通婚現象顯著增加。目前相關移民法規主要規範在《入出國及移民法》、《國籍法》、《台灣地區與大陸地區人民關係條例》等等，上述法條對外籍配偶與大陸配偶移入分別設有不同的規定，外界遂有差別待遇之觀感。本文就我國對於「外籍配偶」保障範圍，探討現行法規區分外國人與大陸人並給予兩者差別待遇的情形，同時就離婚後的「外籍配偶」居留問題，認為我國應參照國際人權保障趨勢，擬訂保障「外籍配偶」權益之規範。

A state’s law in governing the legal status of foreigner is the best indicator to reveal that state’s degree of civilization and freedom. Among several related issues, the legal status of foreign spouses deserve a special attention. With the increasing moving population and the opening of cross-strait relation, the numbers of foreign spouse has been rapidly growing and inevitably have had several impacts on the population and social structure of Taiwan. Relevant legal references governing the legal status of foreign spouses include Immigration Act, Nationality Act, and Act Governing Relations between the People of the Taiwan Area and the Mainland Area, etc. Those different acts in fact provide different treatments to the foreign spouse and spouse from Mainland China. This article analyzes the scope of protection to the foreign spouse, the different treatments provided to the mainland spouse and the legal status of the divorced foreign spouse. Ultimately, this article urges that the Taiwanese government shall enact a law to protect the rights of foreign spouse in accordance with the trend of international human rights protection
