WTO體制下國內治理的「正當程序」規則研究

Rules of 'Due Process' in Domestic Regulation under the WTO System

作為國際經濟領域中最為重要的全球治理機制，WTO為成員方的國內治理設置了程序性規定，其中包括對正當程序的強制性要求。國內治理的正當程序規制具有其獨特價值，更佐證了WTO的合法性。在WTO體制下，通過規則制定與爭端解決，基本實現了對成員方國內治理的正當程序規制。我國在辦清正當程序規制的價值基礎上，應適應並能動地使用正當程序的國內治理規則，保障公正與合理的國際經濟秩序。As the most significant global governance mechanism in the in-ternational economic arena, WTO agreements set procedural requirements in do-mestic regulations, including the compulsory requirement of 'due process', to Members. 'Due process'in domestic regulation has its unique value, which also offers evidence to the legitimacy of WTO. Under the WTO system, through the rule-making and dispute settlement mechanism, 'due process'in domestic regu-lation has been realized. With exploration of the value of 'due process', China should be adapted to 'due process'proactively, as well as its application, so as to ensure a fair and equitable international economic order.
