市場監管的正當性源自市場運行存在內生性缺陷及其安全風險並需要外力矯正，在法治理念指導下，市場監管的本質是一種法律監管，而不是權力監管。盡管市場監管法可能含有具有行政法屬性的法律規範，但市場監管法的調整對象是市場結構利益關係，這些規範不能改變其秩序性規則的整體性質。The legitimacy of market regulation originates from the endogenous defects and security risks of market operation and the need for external rectification. Governed by the ideology of the rule of law, the nature of market regulation is a kind of legal regulation, rather than power regulation. Objets adjustd by market reg-ulation law are interest relationships affected by market sturclure. Although market regulation law may contain legal norms with attributes of administrative law, these norms can not change the holistic nature of market regu-lation law as a law of rules of order.
