論婚姻家庭住房權的優先保護－－與「否定說」商榷

On the Prioritized Protection of Housing Rights in Family Law: Discussion with the “Negative Theory”

優先保護婚姻家庭住房權，具有重要的功能和價值，在我國不僅具有法理基礎，而且具有現實的社會基礎。從域外立法例看，一些國家已經有對婚姻家庭住房權有優先保護的立法內容。基於我國現實國情，宜借鑑他國立法經驗，建立婚姻家庭住房權優先保護制度，以彰顯我國憲法尊重和保護人權的基本理念，實現法律對婚姻家庭當事人之基本人權的保障The priority of protection of housing rights in family law which have lots of functions and values has philosophical and social basis in China. Some foreign legislations have prioritized the protection of housing rights in family law. Based on the national conditions, our country shall establish the system of prioritized protection of housing rights in family law to demonstrate the protection of human rights in China's constitution and realize the safeguard of fundamental human rights of family members in law.
