中國憲法權利「新」類型的劃分、解釋與應用

A“New”Division of China's Constitutional Rights

關於中國憲法權利的研究存在著諸多缺陷，而導致研究缺陷的一個重要原因就是對中國憲法權利的分類針對性與科學性不足。基於規範依據，可將中國憲法權利劃分為單一憲法權利與複合憲法權利；基於權利內容，可將中國憲法權利劃分為基本權利與非基本權利。運用“新”分類所蘊含的關係原理，既可對中國憲法權利本體問題及衍生的關係問題作出解釋，也可對中國憲權利的護衛機制進行設想與展望。One e1ement having 1ed to 10ts of defects in studying China's constitutiona1 rights is 1ack of know1edge of importance of their scientific division.
