論民法解釋學的範式——以共識的形成為研究視角

Paradigm of the Judicial Interpretation of Civil Law

範式是形成共識的基礎。司法時代的到來，需要形成民法解釋（學）的範式。立法時代的“不斷重複一個夢幻，就能把它變為現實”的論調並不能形成共識，也不能適應司法時代對民法解釋的要求。立法者對民法解釋在立法中的地位與作用、司法者對民法解釋方法運用，以及學者對民法解釋學的範疇的共識達成，是中國法律職業共同體形成的關鍵因素。形成這些共識，也是中國民法學建構的必要條件。

Paradigm is the basis of consensus. With the era of China's legislation shift to the judicial treatment, the interpretation of civil law paradigm should be formed. The argument that 'repetition of a dream, will be able to put it into reality' in legislative age can't reach a consensus, nor be applied to the interpretation of civil law. Law hermeneutic is very important in the law application, If the judge can reach a consensus on the judicial interpretation of the law, and the legislators reach a consensus on the position and role of the judicial interpretation, and scholars reach a consensus on law hermeneutic, the key factors in the formation of the legal professional community in China would be found, satisfying the essential conditions for the construction of the science of civil law.
