What is Legal Dogmatics and the Problematic Issue of Legal Dogmatics in China

當代中國的法教義學研究在方法論上還有很大分歧。就其特定的立場和方法而言，法教義學是對由本國立法條文和司法案例中的法規範構成的實定法秩序做出體系化解釋的法學方法。法教義學與其他法律解釋方法的主要差別，體現在對實定法秩序體系化解釋的司法中心主義。這就要求法教義學既必須給價值判斷留出彈性空間，同時又必須保持法律體系的相對封閉性。然而，法教義學的中國化過程，在一定程度上偏離了原本的立場和方法。這一方面表現為對立法中心主義的法律解釋學的沿襲，因此難以擺脫概念法學的積習。另一方面則表現為不以本國司法裁判為法律教義，缺少實定法的司法維度，仍然主要依賴於對國外法學理論的“法學繼受”。要推進真正的法教義學的研究和教學，需要清除偽裝為法教義學的概念法學、繼受法學和立法論思維。

For the legal scholarship in contemporary China, it is necessary to define what is the Legal Dogmatics. According its position and methodology, Legal Dogmatics is a legal method to systemize the positive legal order of the binding and governing legal rules in legislative articles and judicial decisions of a state. The main difference of the Legal Dogmatics from the Legal Hermeneutics is its judicial centralism in the systematic explanation of the judicial decisions from the positive legal order. The key problematic issue of the Legal Dogmatics in China is the neglect of the domestic judicial decisions as the legal dogma, the lack of the judicialdimension of the legal order, and dependence on the foreign theories through the legal transplantation. The value judgment of the main Chinese Legal Dogmaticsis the foreign theories through the legal transplantation. The Legal Dogmatics leaves a room but not a specific method to its value judgment. The law and social science is hard to take the place of the Legal Dogmatics in the value judgment issues. The promotion for the true Legal Dogmatics in China has to clean away the false one; the legal hermeneutics, the legal transplantation, and the legislative thinking in the name of the Legal Dogmatics.
