The conviction of Khieu Samphan and Nuon Chea by the Extraordinary Chamber of the Courts of Cambodia (ECCC) on August 7, 2014, marked an important step of Cambodia's enterprise for transitional justice. Nevertheless, the long overdue judgment suggests a trecherous rather than promising future facing the ECCC. Since its establishment, the ECCC has been criticized forby constant political interference and institutional defects. This article intends to offer a historical review of the creation and operation of the ECCC. Moreover, the performance of the ECCC is compared with other mixed courts to revisit the deterrence logic supported by quantitative literature. Finally, the possible approaches to continue the enterprise of transitional justice in Cambodia are discussed. |
