Modern society is a society ruled by laws. Relationship be-tween the people, all in accordance with the provisions of the law, in order to avoid disputes caused by the blurred boundaries. The relationship between employers and employees are the same. The government drew up labor laws to set up the provisions of rights and obligations between employers and employees, it's the same in Taiwan. Labor contract law regulated the rights and obligations both of the employers and employees in Taiwan. Labor contract law legislation completed in 1936, but so far not implemented. Alt-hough the implementation of the Labor Standards Law in 1984, defined the definition of the labor contract, the termination notice and the contents of the collateral obligations, but the rapid development of the socioeconomic environment , relevant provisions have not in response to the needs of the times. If collateral obligations are not clear enough, not only influenced the implementation of the labor contract, but also affect the harmony between employees and employers. A result of this re-search project, is to study the collateral obligations positioning in the employee-employer relationship, clarifying the scope of the collateral obligations, summarized the situations affect the collateral obligations, review the collateral obligations and analysis should be performed under different conditions, examined the consequences of not fulfill the collateral obligations. Based on the outcome of the analytics, guiding principles are provided to deal with the legislation needs of collateral obligations in the future. |
