船員被判決有罪之論證與省思

The Argument and Deliberation about Criminalization of Seafarers

在許多海事船難事件中，船員不斷受到逮捕、拘留議題，已逐漸受到全球的關注。船員被判有罪，不僅影響海運業的人力招募，同時侵害船員個人基本人權。本文論證從事海運工作之船員，應有免於被起訴恐懼之權利，海事船難事件中盡力挽救船隻，避免污染擴大，且沒有故意意圖之船員，不應受到各國拘禁及罰款之懲處。

There are widespread concerns about arrest and detention of the seafarers in marine accident. The criminalization of seafarers not only influences the industry to attract manpower, it also seriously affects seafarers' human rights as well. We argue that seafarers should have the right to do their job without fear of being prosecuted. Those seafarers who try their best to secure ship in a marine accident should not be imprisoned or imposed a fine on them.
